Terms of service for EstavaNKey

These Terms govern access to and use of EstavaNKey services related to real estate contract review, title searches, conveyancing assistance and ownership documentation. By engaging our services you accept these Terms. We provide legal support and professional advice based on information you supply and public records; clients remain responsible for final decisions.

Eligibility

Services are available to individuals and entities legally capacityed to enter into agreements in Malaysia. By using EstavaNKey services you represent that you have authority to instruct our firm on the property matter in question.

Clients must be at least 18 years old or meet local legal thresholds for entering contracts. If engaging on behalf of a minor or protected person, disclosing appropriate authority and documentation is required.

You must use services lawfully. Instructions that facilitate unlawful actions, fraud, evasion of legal obligations or infringement of others' rights will not be accepted.

EstavaNKey provides services focused on Malaysian real estate law. Where cross-border issues arise we may coordinate with foreign counsel but do not assume responsibility for foreign law outcomes.

Client accounts and access

Clients may be provided with a secure account on EstavaNKey.info to upload documents and track case progress. Access is subject to authentication requirements and these Terms.

Clients must provide accurate and complete information. EstavaNKey relies on client-supplied facts, registers and third-party reports; we are not responsible for errors from external sources unless arising from our negligence in handling them.

You are responsible for maintaining the confidentiality of your account credentials. Notify us promptly of any suspected unauthorized access. We will take reasonable steps to secure accounts but are not liable for losses from compromised credentials where prompt notice was not provided.

Accounts, subscriptions or professional opinions provided by EstavaNKey are personal and non-transferable without prior written consent.

If you suspect your account has been compromised, contact our support immediately via the client portal. We will suspend access and take steps to protect your information while contribute.

EstavaNKey may suspend or restrict access to accounts where necessary to protect data, contribute misuse, comply with legal obligations or for non-payment of fees.

Scope of services

Our legal support includes contract review, drafting of sale and purchase agreements, due diligence advice, coordination with land registries, assistance with transfer documents and recommended steps for securing ownership title. Advice is tailored to facts disclosed by the client and public records available at the time of instruction.

We may modify the scope or delivery of services to reflect changes in law, registry practices or professional standards. Material changes to service scope will be communicated to affected clients and agreed where necessary.

Service availability depends on registry processing times, third-party responses and client cooperation. EstavaNKey will advise on expected timelines based on current conditions but cannot control external delays.

Acceptable use and client responsibilities

Clients engaging our services agree to the following rules which support professional conduct and efficient delivery:

  • Provide truthful, complete information and all documents relevant to the matter in a timely manner.
  • Act in good faith during negotiations supported by our counsel and do not use our services to attempt to mislead third parties.
  • Respect confidentiality obligations and do not disclose privileged communications without consent.
  • Comply with agreed payment schedules for fees and disbursements.
  • Cooperate with reasonable requests for instructions, signatures and identity verification.
  • Refrain from submitting content that is unlawful, defamatory, or infringing on others' rights.
  • Notify EstavaNKey promptly of any material changes affecting the transaction or ownership claims.

Client materials and documents

Clients may submit contracts, title documents, correspondence and other materials to EstavaNKey. Such materials are used to provide informed legal advice and to complete required filings.

You retain ownership of documents you supply. By submitting materials you represent you have the right to share them and that they do not unlawfully infringe third-party rights.

By sharing materials with EstavaNKey you grant a limited, non-exclusive license to use those materials for the sole purpose of providing legal services and fulfil legal obligations connected to your matter.

You are responsible for ensuring documents are accurate and complete. EstavaNKey may rely on certifications, searches and third-party reports; verify these sources where critical to transaction decisions.

Request removal of non-essential client-supplied materials through your account or by contacting support. Removal requests are subject to retention requirements imposed by law and professional obligations.

Intellectual property

All intellectual property on EstavaNKey.info, including legal templates, guidance materials and branding, is owned by EstavaNKey or licensed to it. Users are granted no rights except as expressly provided in these Terms.

  • Do not copy, reproduce or distribute EstavaNKey proprietary materials without prior written consent.
  • Do not use EstavaNKey activity, logos or service marks without permission.
  • Do not attempt to extract content to create competing services or products.

Fees and paid services

Some services and document preparations are provided for a fee. Fee structures are disclosed prior to engagement and agreed in an engagement letter or invoice.

Fees are set based on the complexity of the matter, estimated workload and any third-party disbursements. Estimates are provided in advance where possible and are not fixed unless stated in writing.

Payments may be required upfront, on milestones, or upon completion, as set out in the engagement agreement. We accept payment via methods listed in the engagement documentation.

Where subscription or retainer arrangements exist, terms for renewal, termination and scope inclusions will be set out in a separate agreement.

Refunds, where any are considered, will be assessed on a case-by-case basis taking into account work performed and third-party costs already incurred.

Clients may cancel services subject to obligations to pay for services already rendered and disbursements incurred. Cancellation terms will be set out in the engagement letter.

Applicable taxes such as service tax or GST are the responsibility of the client unless otherwise stated. Fee quotes exclude taxes unless specified.

EstavaNKey reserves the right to update pricing. Existing clients will be notified of material price changes in advance when practicable.

Failure to pay invoices may result in suspension of services and, if necessary, recovery actions to collect outstanding amounts, including legal action where appropriate.

Professional disclaimer

Information and general guidance provided by EstavaNKey are for the purpose of assisting clients with real estate contract and ownership matters. Advice is based on the facts provided by the client and public records; outcomes depend on factual and legal circumstances and cannot be predicted with certainty.

Limitation of liability

To the fullest extent permitted by law, EstavaNKey's liability for any claim arising from services is limited to direct losses reasonably foreseeable at the time of engagement. We are not liable for indirect, consequential or punitive damages or losses arising from third-party actions or registry delays.

Third-party services

Where EstavaNKey refers clients to third-party service providers, such as valuers or funding consultant, we do so for convenience. Engagement with third parties is at the client's discretion and subject to separate terms between the client and the third party.

Termination of services

Either party may terminate engagement in accordance with the terms of the engagement letter. Termination does not relieve the client of obligations to pay for services performed and disbursements incurred up to the termination date.

On termination we will deliver client files and necessary transfer documents upon settlement of outstanding fees and completion of identity verification where required by law.

Privacy and data protection

Our privacy practices are described in the EstavaNKey Privacy Policy, which forms part of these Terms. By engaging our services you consent to processing of personal data in accordance with that policy.

Communications

We communicate by email, secure client portal messages, telephone and post. Clients must ensure contact details are current. Service-critical communications may be sent by email or portal and should be reviewed promptly.

Changes to terms

We may update these Terms from time to time. Material changes will be notified to active clients and published on EstavaNKey.info with an updated effective date.

Governing law

These Terms are governed by the laws of Malaysia. Parties submit to the non-exclusive jurisdiction of Malaysian courts except where alternative dispute resolution is agreed.

Dispute resolution

Where disputes arise, parties should first seek to resolve matters by negotiation or mediation. If unresolved, disputes may proceed to arbitration or court in Malaysia in accordance with the agreed procedure.
